Understanding Hypothecation entry in RC — Form 34

Record a vehicle loan hypothecation in the RC when your bank requires it before disbursing a vehicle loan.

Who applies

Any vehicle owner who has taken a loan from a bank, NBFC, or other financier to purchase the vehicle and needs to record the lender's (hypothecatee's) name on the Registration Certificate (RC) as a charge on the vehicle.

Who should use this process

  • Applicable when a vehicle loan is taken from a bank or NBFC and the vehicle is purchased under a hire purchase, lease, or hypothecation agreement.
  • The vehicle must already be registered (RC must exist) — hypothecation is typically entered at the time of initial registration for new vehicles, or subsequently for refinancing.
  • Both the vehicle owner (hypothecator) and the financier (hypothecatee) must sign Form 34.
  • The vehicle's RC must be valid and not under any dispute or court order.

Who does NOT need to apply

  • Hypothecation cannot be entered if the vehicle already has an existing hypothecation entry from another lender — the previous hypothecation must first be terminated via Form 35 (Process 043).
  • If the vehicle's RC is expired, the RC must first be renewed before hypothecation can be entered.

Step-by-step guide

    Obtain Form 34 and the financier's letter

    Obtain Form 34 from the RTO counter or download it from the Vahan portal. The bank or NBFC typically fills in its details (financier name, address, agreement reference) and signs the form. Get the accompanying hypothecation request letter from the bank on their letterhead.

    Vehicle owner signs Form 34

    Both

    The vehicle owner (hypothecator) completes and signs Form 34. Ensure all vehicle details (registration number, chassis no., engine no.) and financier details are accurately filled.

    Initiate application on the Vahan portal (where available)

    In states that support online Vahan services, log in to vahan.parivahan.gov.in and submit the hypothecation entry application online. Upload scanned copies of Form 34, loan agreement, and financier letter.

    Visit the RTO with the original RC, original Form 34, original loan agreement, financier's letter, insurance certificate, and PUC. Submit at the vehicle registration counter. Pay the applicable fee.

Things to watch out for

Hypothecation entry is separate from insurance naming

Recording the financier on the RC (via Form 34) is different from naming the bank as a co-beneficiary on the insurance policy. Both should be done: the RC must show the hypothecation, and the insurance policy should name the bank as an 'on behalf of' party. Confirm with your bank.

Vehicle cannot be sold or transferred while hypothecation is active

As long as the hypothecation entry is present on the RC, the vehicle cannot be transferred to a new owner without the bank's NOC and Form 35. Do not agree to buy or sell a hypothecated vehicle without first ensuring the loan is cleared and Form 35 has been processed.

Banks often delay the financier letter

The bank or NBFC's letter and signed Form 34 can take days or weeks to arrive after the loan is disbursed. Follow up promptly with the bank so you can complete the RTO formality without delay.

Ensure correct financier name spelling on Form 34

The financier's name on Form 34 must exactly match the registered name of the bank or NBFC as it appears in the loan agreement. Any mismatch will cause the RTO to reject the application and require a fresh form.

Digital RC in DigiLocker reflects hypothecation

After the hypothecation entry, the digital RC in DigiLocker will show the financier's name. This is important during traffic checks — traffic police using the digital version can verify the hypothecation status.
