Understanding Hypothecation termination — Form 35

Remove the hypothecation entry from your RC after fully repaying your vehicle loan before selling the vehicle.

Who applies

Any vehicle owner who has fully repaid their vehicle loan and wants to remove the hypothecation (bank/NBFC lien) entry from the Registration Certificate (RC) so that the vehicle is free of any financial encumbrance.

Who should use this process

  • The vehicle loan must be fully repaid; the bank or NBFC must issue a No Objection Certificate (NOC) / Loan Closure Letter confirming complete repayment.
  • The existing hypothecation entry must be recorded on the RC — there must be an active Form 34 entry to terminate.
  • The vehicle's RC must be valid.
  • Both the vehicle owner and the financier must sign Form 35.

Who does NOT need to apply

  • Hypothecation cannot be terminated if there are outstanding loan dues. The bank will not issue the NOC until the full loan amount, including any foreclosure charges, has been paid.
  • If the RC is expired, it must be renewed before hypothecation termination is processed.

Step-by-step guide

    Repay the vehicle loan fully and obtain NOC

    Offline

    After making the final loan payment, formally request the bank or NBFC to issue a Loan Closure Letter / No Objection Certificate (NOC) confirming that the loan is fully repaid. Also request the bank to sign Form 35 (or provide their signed portion of Form 35).

    Obtain and fill Form 35

    Download Form 35 from the Vahan portal or collect it from the RTO. Fill in vehicle details, owner details, financier details, and the loan closure information. The bank's authorised signatory must countersign Form 35.

    In states supporting online services, log in to vahan.parivahan.gov.in and submit the hypothecation termination request online. Upload Form 35, bank NOC, and other documents.

    Submit documents at the RTO

    Visit the RTO with the original RC, original Form 35, bank NOC, insurance certificate, and PUC. Submit at the vehicle registration counter. In states with full online processing, the RTO visit may not be necessary.

    Pay the ₹100–₹200 hypothecation termination fee at the RTO cashier or online. Collect the payment receipt.

    Receive updated RC without hypothecation

    Offline

    The RTO updates the Vahan database to remove the financier's details and issues an updated RC. The smart-card RC dispatched by post will not show any hypothecation entry. The digital RC in DigiLocker is also updated.

Things to watch out for

Obtain the NOC before it expires

Bank NOCs have a validity period (typically 30–90 days). Ensure you submit the RTO application within the NOC's validity window. If the NOC expires, you will need to request a fresh one from the bank, which may take additional time.

Vehicle cannot be sold until hypothecation is removed

An RC showing hypothecation will raise red flags for any prospective buyer and their insurer or lender. Complete Form 35 as soon as you clear the loan so the vehicle is free of encumbrances and can be sold or transferred without complications.

Collect all original loan documents from the bank

When collecting the NOC, also ask the bank to return any original documents they may be holding — such as original sale invoices, insurance documents, or other papers submitted at the time of the loan. Banks sometimes retain these and may delay handing them over.

Check Vahan after 15 days to confirm the update

After the RC is updated, verify on the Parivahan portal (vehicle registration details) that the hypothecation entry no longer appears. Occasionally, database updates are delayed and the old entry persists — if so, contact the RTO with your payment receipt to rectify.

Insurance naming should also be updated

If the bank was co-named on the insurance policy, inform your insurance company after the hypothecation is removed. Update the policy to reflect sole ownership, which may also affect your claims process.
